The Freeway State Highway Speeding Case
This type of case I often win in a full on court trial with subpoena, law motions and my trial expertise. My court trial fee is $1860 plus the cost of a service of process fee for the subpoena.
I can also recommend fighting the case with a Trial by Declaration as a way to start the battle. My fee for preparing it with law defenses is $460.
In a Trial by Declaration there is no court appearance and everything is decided by a judge reading my Trial by Declarations with its law defenses and memorandum to dismiss and reading the officer’s declaration.
The advantage of a Trial by Declaration is that even if you lose the Trial by Declaration you still have the right to a court trial. And the case can be won at this level!!
If the Trial by declaration is not won, I will deduct the $460 from my trial fee and fight the case in court for you for $1400. I cannot overstate the tremendous win difference between a court trial and a Trial by Declaration.
In a court trial I am personally present. I use very powerful written law motions and serve a subpoena for defense trial evidence and I’m there to advocate the defenses I know so well. It’s the best way to get the case dismissed, or to get a plea bargain that does not have a dmv point.
When you consider that a conviction will cost you about $1800 in insurance increases over the next three years, fighting the case makes a lot of sense.
The 22349 or 22356 VC case (a freeway speeding case) is particularly suited for a competent trial defense. The reason is the officer has so many things he has to do right to get a conviction. I win cases because the officer is often not prepared for trial.
He is often over confident and comes to court believing he’s going to win because an average citizen will try to fight the case without knowing anything about the law and without being able to object to the officers inadmissible hearsay testimony. The citizen also doesn’t know the first thing about how to keep radar/laser and speedometer evidence out of court.
Officers win about 99 percent of the cases against unknowing citizens for that reason, that’s why they are so over confident. When I show up to defend you, their confidence is shattered and they often lose the case.
Officers have become over confident (they win ALL the time against non lawyers) and often do not bring the necessary admissible evidence to court. This is true if the officer fails to bring an admissible radar/laser calibration or speedometer certificate to court or he fails to have an admissible radar/laser training certificate.
Just a word about the admissibility of evidence. The officer must bring a legally certified document to court and often they bring photocopies of the certificate and I know how to keep that evidence from being admitted in court against you.
If the case is a pacing case, rather than radar, I have a evidentiary objection that will keep his speedometer certificate out of evidence every time. That’s how I win 22349/22356 VC cases. Further, there is the real possibility of a plea bargain to a non moving violation. In the plea bargain situation it is necessary for me to be charming to the officer, and boy, am I charming!
