HOW TO STOP A DMV SUSPENSION IN ONE DAY
Whenever a person accumulates DMV points, they appear on his Driving Record. Most people just pay the ticket and get the point added to their record.
The process goes something like this. The driver mails his payment to the court or goes to the court and pays it at the window, or pays online. Anytime a person just pays the ticket, that point can be set aside.
I have specialized in doing just that and have never failed to set aside a point where the driver just paid it. I am not talking about the driver who appears in front of a judge and pleads guilty and gets the point.
I should say that it is still possible to set aside a point if the driver appeared in front of a judge and plead guilty. But that is another story.
If you have lost your license because you have too many points, I certainly may be able to get your license back for you, if you just paid the ticket.
The first thing I do is find out if you have tickets you just paid. Then I look for the best ticket to beat in court in trial. That is the ticket that I will set aside for you.
Here is what I do. I prepare a special law motion to "Set Aside the Forfeiture of Bail". So, the motion I file sets aside the point immediately and I set the matter over for trial. Your fine is used as trial bail. I return to the court and beat the ticket to keep it off your record. I have done this 19 times in a row and successfully, to stop suspensions and save jobs.
In every case so far, the courts have agreed with me and granted my motion. Iʼve had one of the brightest judges in California challenge my motion but after 2 months of trying to defeat my motion, he gave up and conceded that my motion was well grounded in the law. He set aside the point forthwith and set the matter for trial.
Then I contact the DMV to advise them that your point count is now reduced and the suspension is over and you get your license back.
The California DMV says that if you have 4 points within a year, or 6 points within two years or 8 points within three years, they may suspend your license. You can see that when I reduce the point count below that suspension threshold, the suspension must end.
Once the court has granted my motion and set the matter for trial and removed the DMV point, I then must return to court and win the trial to keep that point off. So far, I have kept every point off by either winning at trial or getting traffic school for my clients.
